Welcome to Poll Pixie. By accessing or using our website, services, or applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Snapit Software ("Company," "we," "us," or "our"), operated by Terrell Flautt, located in Coupland, TX 78615, USA.

2. Description of Service

Poll Pixie provides online poll creation, voting, and analytics services. Our Service allows you to:

• Create polls with multiple question types
• Share polls via links and social media
• Collect votes anonymously or with authentication
• View real-time voting results and analytics
• Export poll data in various formats
• Embed polls on external websites

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts and Registration

To access certain features of the Service, you may need to create an account. When creating an account, you agree to:

• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

• Manipulate voting results or engage in vote fraud
• Create misleading or deceptive polls
• Spam or abuse the poll creation or voting systems
• Create polls containing illegal or harmful content
• Infringe on intellectual property rights
• Circumvent rate limits or abuse the Service
• Use automated systems to vote or create polls

5. Payment Terms

For paid subscription plans:

• Payment Processing: All payments are processed securely through Stripe. We do not store your complete payment card information.
• Subscription Billing: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
• Price Changes: We may change our prices with 30 days notice. Existing subscriptions will honor current pricing until renewal.
• Refunds: We offer a 30-day refund policy for annual subscriptions. Monthly subscriptions may be cancelled at any time but are non-refundable for the current billing period.
• Vote Limits: Votes exceeding your plan limits may be restricted until upgraded or the next billing cycle.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Snapit Software and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of poll questions and content you create. By creating public polls, you grant other users the right to view and participate in voting.

7. User Content and Data

You retain ownership of:

• Poll questions and answer options
• Poll configurations and settings
• Aggregated voting results and analytics

By using the Service, you grant us a limited license to process your data solely for providing the Service. For public polls, you grant us the right to display poll content to all users.

Voter Privacy: Anonymous votes are not linked to individual identities. For authenticated voting, voter information is protected according to our Privacy Policy.

8. Service Availability

We strive to maintain high availability but provide the Service on an "as-is" and "as-available" basis.

• Free Tier: No service level agreement (SLA) is provided. Service may be interrupted for maintenance.
• Paid Tiers: We make commercially reasonable efforts to maintain uptime for real-time voting features.

We are not liable for lost votes, incorrect results due to service interruptions, or any downtime.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT RESPONSIBLE FOR DECISIONS MADE BASED ON POLL RESULTS
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

• Your right to use the Service ceases immediately
• Your polls may become inaccessible
• We may delete your account and associated data after 30 days
• You should export any data you wish to retain before termination

You may terminate your account at any time by contacting us or using the account settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website
• Updating the "Effective Date" at the top of this page
• Sending email notification for significant changes (for registered users)

Your continued use of the Service after changes constitutes acceptance of the modified Terms.
